Trenton Man About to Spend a Decade in Jail for Stealing Social Security Disability Benefit

A 55-year old Trenton man is about to face his 10–year jail sentence after the court judge ruled over the lawsuit filed against him.

On April 26, John Bethea is about to report to the federal jail to start accomplishing his 10–year jail sentence after the US District Judge Joel A. Pisano decided on his theft of government funds and misrepresentation of social security number case.

According to the court papers, Bethea stole about $90,000 in social security disability benefits by using his brother’s social security number. Bethea started receiving social security disability benefits since August 9, 1991 while working for three different employers in New Jersey. He earned more than $188,000 without informing the Social Security Administration (SSA).

Bethea even used his brother’s social security number to obtain a New Jersey driver’s license with his brother’s name and picture. He used that fraudulent license to obtain a job under his brother’s identity. The same also enables Bethea to continue receiving Social Security disability benefits while working.

When Bethea sustained an injury at the workplace, he used that same identity to collect another $28,000 for worker’s compensation.

However, nothing really lasts forever Bethea was eventually caught in his fraudulent act. During his litigation, Bethea pleaded guilty for all the charges against him and agreed to pay restitution to the social security amounting to $89,216 and repayments to Amguard Insurance Co. for the worker’s compensation at about $28,436.

According to Lt. Patrick Sheridan, Maggie served the Louisa County Sheriff’s office for six years until her last breath; she dedicated her life to protect the citizens of Virginia. In Maggie’s entire career, she responded to 343 calls for duty and assisted in investigations in many jurisdictions. He also assisted the Virginia State Police as well as the FBI.

News said that the pit bull that attacked Maggie is now under the custody of Louisa County Animal Control.

Kidnapper Sues Hostages for Breach of Contract

Two years after the hostage incident that happened last September, 2009 inside the house of Jared and Lindsay Rowley, the suspect is now suing his two for breach of contract.

The Kansas couple was held hostage by Jesse Dimmick of Aurora, Colorado last 2009. Due to the hostage incident, Dimmick was shot at his back by a police resulting to serious physical injury which almost killed him. His hospital bills reached $160,000 which he cannot pay in any way.

During the time of the said hostage incident, the involved couple was newlywed. The couple stated that Dimmick invaded their house which brought emotional distress to both of them. They filed murder case and other charges to the suspect which brought him now in jail. He was sentenced with 11 years of imprisonment.

As a counter complaint to the couple’s lawsuit, Dimmick filed a breach of contract lawsuit against the Rowley couple. Allegedly, the couple violated their oral contract to cover up his crime in exchange for money.

The Rowley couple affirms that there was no such agreement and if there was any, it was null and void due to lack of legality.

In his lawsuit filed last month, Dimmick is claiming for a $235,000 for a breach of contract. He claims that he suffered a gunshot at his back that almost killed him and brought him into hospital indebtedness.

According to a news report at USA Today, the police officer who shot Dimmick said that his riffle accidentally discharged during the hostage incident.

Dimmick also named the City of Topeka in his breach of contract lawsuit, seeking for $75,000.

The couple has filed a motion to dismiss Dimmick’s lawsuit and apparently the judge is considering dismissing the same.

It’s very absurd that the hostage suspect still have the guts to file for a breach of contract lawsuit. This is not a kind of business wherein if one does not obey what has been set into the agreement or terms of condition, the other one can file for a breach of contract. The reality is, he committed an actual crime. Therefore, he deserves to be penalized and not to let him spin the law.

Atlanta Construction Site Accident Kills Two Workers

A construction site accident that occurred last December 1 at the Dallas Street, Atlanta has left two workers dead. The victims were identified as Rigoberto Lopez, 29, from Marietta, Georgia and Karlos Turner, 42, from Dallas, Texas.

Reports said that the two men were stuck while working on an 80-foot lift which was extended to a height of 40 feet on the exterior of Amli Old 4th Ward Apartment Homes. The lift fell onto the concrete path across the street as the men were trying to move it.

The victims were rushed to the hospital but were pronounced dead shortly after they arrived. Findings of the doctors show that Lopez and Turner sustained fatal injuries.
Allegedly, a machine malfunction was seen as a factor to the accident.

An investigation regarding the fatal construction site accident is still in progress. However, the Occupational Safety and Health Administration (OSHA) is still expected to conduct an investigation.

American Airlines Sued in Passenger’s Death Caused by Food Poisoning

In Miami, an American Airline is currently facing charges for the death of one of its passengers from its flight way back on May, 18, 2011.

Allegedly, the 73 – year old man died aboard on one of the airlines’ flight from Barcelona to New York after eating a contaminated chicken meal.

As the family boarded for their next flight from New York to Miami, Cortes’ condition grew worse. Along their Miami bound flight, Cortes was already suffering nausea, dyspnea and a cardiac event. The flight made an emergency landing at Norfolk, Virginia but it was too late for Cortes’ medical treatment because he was declared dead in Virginia.

In Cortes’ family lawsuit, they also claim that the airlines should not have allowed Cortes to board the Miami flight without securing medical attention first from the airline’s medical team.

The American Airlines’ spokesperson said the airlines company would not comment on the pending lawsuit. On the other hand, the airline catering company mentioned in the lawsuit had also given their statement saying that the company did not cater for that flight and that they have been working to have the lawsuit dismissed.

Six Football Players Killed in a Bus Accident in Africa

In Togo Africa, six soccer players have been killed in a bus accident while twenty – eight (28) others were injured.

The six football players killed in the accident were all members of the Etiole Filante team. The accident occurred while the team is heading to Togo’s second largest city - in Sokode last Saturday for a match scheduled for Sunday.

According to reports, a burst coming from one of the tires was heard by the passengers before the bus dropped over and fell down on a ravine causing it to catch fire.

Apart from the six football players who died on the accident, twenty – eight (28) others were seriously injured. One of the survivors stated that they can’t even remember how they managed to get out of the flaming bus.

Some of the victims reportedly died due to burns and not from the accident itself. Most of the players whom were able to get out of the bus were all in the front rows.

Casualties were assisted by the Togo government as ordered by President Faure Gnassingbe. They were brought to the military wing of the Lome Central Hospital for immediate medical treatment. An ambulance was used by a delegation headed by sports minister Christophe Tchao to transport the victims.

The Lome based football team – Etiole Filante, which means shooting star is the seven time champion of Togo’s National Team. The group also became a runner – up in Africa’s continental club competition way back in 1968.

It was only last year when the team experienced the same fatal tragedy in a bus, when their vehicle was attacked by a gun while heading to the African Cup of Nations Tournament in Angola. The incident caused the death of the two of their team officials as well as injuring other players. Now, yet again six of their lead players were killed from this accident

The research group also warned the parents that too loud toys could also cause hearing impairment to their children.

Since 1990 to 2010, statistics shows that nearly forty percent (40%) of choking fatalities are reported to the government. Balloon is included on the list of hazardous toys that causes fatalities to children.

The toy industry points out that the government figures have been declining in national product recalls for toys for the previous years. Figures show reduction from 172 product recalls in 2008; 50 in 2009; 46 in 2010; to 34 in 2011. Toys and baby product recalls linked to lead dropped down from 19 in 2008 to only 4 this year.

According to the Office of Fair Trading, debt collectors usually use social media to locate their debtors and see if there are still any properties or assets they might collect. However, said office had received complaints from the debtors who are being pressured or deliberately harassed online to pay off their loans.

Social media can be a very powerful way to bother someone. Debt collectors can easily post messages in social media to let the whole world know about someone’s indebtedness or contact the debtor’s friends and relatives to have them call their office. In that way, debtors will be forced to pay all their indebtedness. That’s a clear violation of the Fair Debt Collection Practices Act.

Due to the complaints, the Office of Fair Trading has updated its debt collection guidance to condemn the unfair or improper practice of debt collection. It also warned debt collectors that contact debtors at an uncertain time and at inappropriate places.

OFT director of consumer credit David Fisher said that in the current economic status, many people are exposed to financial difficulties. He stressed out that it is very important that debtors must treat those people fairly.

The Financial Ombudsman Service said that problems from debtors are rising from 59% of the complaints in the first six months of the year and keeping one in three debt–collecting complaints.

A 77-year-old woman died after being hit by a vehicle near Los Flores Avenue when she darted into the roadway while chasing after her pooch early Monday morning.

After the accident, the woman identified as Belba Bray, of Buena Park, was taken to a hospital where she later died from injuries sustained in the accident.

Reports show that Bray’s son was nearby and he rushed to the scene when the accident at the 5900 block of Los Feliz Drive occurred. The woman’s dog was later found and was given to him.

The driver of the 2008 Dodge Charger stayed at the scene and cooperated with authorities as they investigated the vehicle accident. He was later released without charges or any citation.

The driver may be free from charges once proven that he wasn’t, in any way, able to prevent the accident that killed the elderly pedestrian. However, motorists should still be cautious and be conscious of pedestrians who may suddenly cross the street. But then again, the woman was probably running to get her dog and so she wasn’t able to warn approaching motorists that she is about to cross and the driver may have failed to avoid her.

In cases like these, it is very unfortunate for someone to lose his life because of a simple misjudgment. The woman shouldn’t have crossed the street even if her dog got away as she had put herself in more danger by doing so. She should have scanned the road first for approaching vehicles or asked someone to help her chase after her dog.

Hoping for a Touch of Human Ingenuity in Africa

I am a firm believer in human ingenuity and when push comes to shove, I believe that we will find a way to survive even the most cataclysmic of events.

Sometimes you just wish that the same ingenuity can be used to solve the current problems that are being faced by the planet and that we do not have to face certain extinction before we do something about it.

The water problem in Africa for instance; according to H2O Africa foundation, more than 2 billion people have no access to clean water and sanitation.

We are in the new millennium and you would think that access to safe drinking water should no longer be an issue.

But that is not the case.

About 4 out of 5 Africans still use ground water as their main water supply.

The main problem is that ground water is not always clean and it only comprises about 15 percent of the continent’s water supply.

Why they depend on this ground water if it is only 15 percent of the water available, you may ask.

The answer goes back to technology, or the lack of it.

Many of the tribes in Africa do not even have electricity so they do not exactly have the technical knowledge and the resources to take advantage of their inaccessible water supply.

But you just look over the Internet and you will find that there have been various breakthroughs in technology that should be able to help the water and sanitation crisis in Africa.

There is even a technology that creates potable water out of thin air that will be used by US troops in Iraq to provide them clean water supply anytime they are on a mission.

I am not trying to take away anything from our troops, but I think the right sentiment is why is that technology being used in war and not to save lives?

But as most economists will tell you, people respond to incentives and there is not much incentive in helping Africa aside from the usual thank you and deep gratitude.

The most that we can do is to spread awareness about the problem and contribute to the organizations who champion the cause of the people of Africa.

Maybe someday (hopefully before an end of the world scenario) our human ingenuity will be coupled with our sense of compassion and ability to do good even for the slightest incentives.

Then finally, we can really say that we can change the world for the better.

Boy Injured in Glendora Bicycle Accident

Children are the most vulnerable to serious and fatal injuries in bicycle accidents that is why the family of the boy who got struck by another vehicle in Glendora is lucky that he only sustained minor injuries.

The collision between the young bicyclist and the other vehicle occurred near the intersection of North Glendora Avenue and East Bennett Avenue.

The details on how the two vehicles crashed with each other is not clear except that the boy was riding his bike on East Bennett while the other vehicle was on traveling on North Glendora before the bicycle accident.

There was no report on what or who caused the crash.

The boy was airlifted to a nearby hospital as precaution even though he did not sustain any injuries and rightfully so, since some of the more serious injuries do not have obvious symptoms.

A Ford Explorer with a possible blown-out tire rolled over in Porterville, Tulare County, causing the driver to sustain major injuries.

According to reports, the unidentified male driver, from Porterville, was traveling southbound of Highway 65, south of Linda Vista Avenue, when he suddenly swerved to the left and rolled over while moving over the center median.

When officers arrived at the accident area, they saw the vehicle upright. They said the Explorer rolled over before it landed on its wheels.

The driver was unconscious when he was found and had to be extricated from the vehicle. He was rushed to Community Regional Medical Center to receive immediate treatment for head injuries.

Reports said evidence shows that one of the Explorer’s tires may have blown out.

This accident may have been caused by tire blowout. Other drivers may hopefully see the importance of checking their vehicle’s tires before they travel. Doing this precautionary action will not take much of their time, but will prevent the occurrence of accidents.

Hotel Workers Seeking $180,000 for Break Violations

Non-management workers of the Embassy Suites, a hotel in Irvine, have recently complained that they weren’t given the mandatory breaks which resulted to $180,000 worth of back wages.

In the complaint filed with the California Department of Industrial Relations recently, at least 30 hotel workers who were represented by their union, Unite

Here, alleged rest breaks violation as the company failed to follow state laws and provide their workers with the mandated breaks.

In the lawsuit, the workers also claims that the Irvine hotel, who employs around 60 non-management workers, hasn’t been providing the said breaks for at least ten years.

The state of California is one of the few states that have a mandated 10-minute rest breaks and a 30-minute lunch break for every eight hours of work. If proven guilty of the offense, the management would have to provide the back wages for all their workers’ missed rest breaks.

56-Year-Old Worker Killed in Evergreen Nursery Freak Industrial Accident

A 56-year-old man, who has been working for 20 years for Evergreen Nursery, was killed after a freak industrial accident in the company’s facility yesterday morning.

According to reports, the unidentified worker’s arm got caught in the conveyor belt of a compost machine that pulled him against its hopper component.

Reports show that both the bicyclist and the driver of a Hyundai sedan were heading east along Parkshore Drive when the accident occurred. The bicyclist was said to have turned left into the path of the vehicle without any warning or indication of his intent to do so.

As a result, the bicyclist went onto the hood and window of the vehicle before hitting the ground. He sustained serious injuries and was taken to the hospital where he is said to be recovering.

Authorities did not believe that the accident was caused by either alcohol or drugs.

Schwarzenegger Demands Chiang to pay Minimum Wage

Pilot Attempts Aerial Stunts, Dies in Crash

Authorities have a reason to believe that the pilot who was killed in a plane crash in Calaveras County Monday morning may have been trying to do some aerial stunts shortly before the accident.

Witnesses say that the pilot, whose identity is yet to be released, was trying to do some flips in the air at about 9 am before the Cessna 172 he was flying crashed into an area near Pool Station Road.

The pilot was found dead and no one was reportedly on board with him. The Federal Aviation Administration said that the registered owner of the 1976-manufactured aircraft lives in Oakdale and was not flying the plane at the time of the accident.

Authorities are yet to determine the cause of the crash.

These aircrafts must be regularly checked to make sure that the pilot would not encounter any trouble while on the air. Also, pilots should not attempt to do tricks if the aircraft that they are using is not in its best condition.

Two utility crew workers are at risk of being terminated by the Department of Water and Power after being caught on video drinking beer while driving a government utility vehicle and spending some time on a strip club to pass time while on the job.

The videos were caught by CBS2 investigative reporters who followed different DWP employees buying liquor and drinking it on their van and spending about two hours inside Alameda Strip – a strip club in Alameda Street.

DWP general manager Austin Beutner said yesterday that the termination process of the two employees has already started and they are also investigating the other employees shown on the video.

The DWP should make sure that due process is given to the employees even if there is incriminating evidence about their misconduct during working hours.

As much as due process is for the benefit of the caught employees, it is also for the employer’s advantage to not rush any decision.

I am pretty sure that they have policies in place to handle these situations and they should be followed.

If the DWP management fails to comply with their own procedures, the fired employees may cry wrongful termination due to not being given their right to due process.

Although the DWP can still defend against such lawsuit, they would still have to spend effort and resources to fight against it.

So DWP can save itself additional headache by following their own rules and regulations.

Palo Alto Council Members Endorse Own Salary Reduction

Home Depot to Pay $25.5 Million for Wage Case Settlement

Home Depot will pay about $25.5 million just to settle a case filed by California workers who alleged that the company did not allow them to take meal and rest breaks.

According to reports, the Atlanta-based company is just one of the retailers that were sued after they have allegedly committed California labor law violations.

The settlement was approved by a Los Angeles Superior judge last January.

The plaintiffs’ legal representatives refused to comment on the issue, but court records revealed that Home Depot Expo and Home Depot workers who are working in the said companies from 2000-2009 are part of the settlement class.

A Home Depot spokesman stated that settling the lawsuit does not mean the company accepts wrongdoings on its part.

Hit and Run Driver Still Sought

These hit-and-run drivers will surely face heavier punishment for leaving the scene of an accident as compared to what he will be charged with had he stopped to look after another person’s well-being.

A 13-year-old boy on his way to school recently lost consciousness after being hit and injured by a parked vehicle from the opposite lane when it suddenly made a sudden U-turn and hit him. The boy was reportedly riding his bike along the northbound lanes of Music Avenue at around 7:30 in the morning when the accident occurred.

The boy sustained facial cuts and injuries to his arms and hand. He told authorities that the vehicle that hit him was a small, gray, late-modeled sedan. Authorities are yet to apprehend the driver.

The Clovis Police Department has appealed for witnesses to come out and contact them so that the driver who left the unconscious boy on the street will be punished.

Truck Accident Kills Motorcyclist in Mt Baldy Road

A truck accident in Mt. Baldy has claimed the life of one motorcyclist last weekend.

The victim was identified by the Los Angeles Coroner’s Office as Jason Stark, 32, of Alhambra.

According to CHP, a Claremont man driving a 1995 Dodge Ram was making a U turn near the mile post marker 3:30 on Mt Baldy Road when he drove directly on the path of the 1999 Ducati that Stark was driving.

Stark tried to stop but he was unable to avoid crashing into the truck.

He was pronounced dead on the scene.

The Dodge Ram driver told investigators that he did not see Stark approaching when he initiated the U-turn.

Although it is not clear who the liable party is, the family of Stark can file a wrongful death claim against the Dodge Ram driver.

Like what I said in previous blogs, California is a comparative negligence state so even if Stark has some fault in the accident, he may still collect damages.

But of course the level of his liability will be computed and that percentage will be subtracted from the total amount that the family will receive from the claim.

White Cop Wins Racial Discrimination and Retaliation Lawsuit against Latino Supervisor

We usually hear about the abusive White man in the workplace, and many discriminatory lawsuits are usually directed to “White” supervisors, managers and employers.

But this time, the victim who won a racial discrimination and retaliation lawsuit is a white cop who claimed that he was discriminated upon by his Latino supervisor.

Officer Paul Waymire was awarded $125,000 for the pain and suffering brought by the actions of his supervisor.

According to the lawsuit, His Latino supervisor treated him differently because he is white and when he filed a discrimination complaint, he was denied promotion even though he is more qualified.

He was actually presented the state’s Public Safety Officer Medal of Valor by Governor Schwarzenegger in 2005 for rescuing a 22-year-old man from a burning car.

With racial discrimination, it does not matter if you are White, Black, Latino or Asian.

And it does not matter if you are in the minority or not, everyone can be a victim.

That is why it is important to know your rights in the workplace so that you can avoid being a victim.

Under Article VII of the Civil Rights Act of 1984, it is unlawful for employers and people of authority to discriminate against a person on the basis not only of race or color but also his religion, gender and national origin.

By knowing your rights, you would know if you are being abused and you can take appropriate actions.

A woman came forward and claimed that she may have been the one who struck and killed a teenager last week on el Camino Road and Cassia Road.

The San Diego Police impounded her car but it is not clear yet if any criminal charge will be filed against the unidentified woman.

According to police, the woman came forward after hearing the news about the hit-and-run accident that killed 18-year-old Steven Kelly.

Kelly was pronounced dead on the way to the hospital after being struck by a car while crossing the road.

The woman said that she suspected that she may have hit something on the road at that time but did not see anything.

Under the law, motorists are required to stop after a vehicle accident.

If the woman has suspected that she had hit something, she should have stopped her vehicle and proceeded to check if she did hit something or someone.

If she found that she indeed hit a person, she could have provided necessary assistance or could have arranged that Kelly be brought to a hospital sooner.

Who knows, it could have saved his life.

That is why she will probably be prosecuted for leaving the pedestrian accident scene.

Will she also be charged for manslaughter? That I do not know.

But the family of Kelly can file a wrongful death case against her if it turns out that she is the one who hit Kelly.

Although it will not bring Steven back, the recovered amount is deserved by the family for what they lost.

2 Killed and 5 Injured in 605 Freeway Multi-Vehicle Crash

At least two people were killed in a multi-vehicle accident in Cerritos last night.

According to CHP, the car accident occurred on the northbound San Gabriel River 605 freeway shortly before 7pm.

Aside from the two fatalities, 5 more people were brought to a nearby hospital for injuries with four in critical condition.

Authorities are still investigating the circumstances which led to the crash.

Finding the liable party in a multi-vehicle crash can be daunting; finding out who struck who first is always a challenge because of the large number of vehicles involved.

Although it is difficult, it is not impossible.

According to Cochran, she became pregnant in 2007 but did not tell anyone because of her fear of being terminated.She claims that because of the stress, she had a miscarriage.She also said that the response of the producer after being informed about the miscarriage is that it is “nature’s way of getting rid of the baby.”

She also claims in the lawsuit that in 2008, the producers did not take it well when she informed them that she was pregnant again.She alleges that the producer said “wide load coming through” when she passed by.

Cochran said in her lawsuit that she went on disability because of complications from her pregnancy and she was eventually squeezed out of the job on February 23.

Bob Barker and his former show “The Price is Right!!” (now hosted by Drew Carrey) are no strangers to discrimination and harassment lawsuits.

Just last September, the court tossed the infamous race discrimination lawsuit filed by Deborah Curling, who alleged that the show fostered a hostile working environment against black employees and contestants.

They are currently appealing the case.

In the case of Cohran, although the law protects employees from disctimination based on pregnancy, childbirth and any related conditions, it is till difficult to prove if it did exist.

For example, some discriminatory comments may come off as just friendly banter that was misinterpreted once presented to the court.

The burden of proof will fall on Cochran and as shown with the case of Curling, Price is Right has a very good legal team.

I hope that she has more compelling evidence to support her case.

Anthem Blue Cross Sued For Breach of Contract over Out-of-State Liver Transplant

Insurance companies are not your friend.

That is the first thing you should learn when dealing with insurance adjusters.

Sure they will try to be friendly with you at first but you should remember that when doing their job, their primary duty is to make money for their company.

I’m not saying that they are bad people; I’m just saying that they are doing their jobs.

Take this latest lawsuit against Anthem Blue Cross.

Ephram Nehme claims that Anthem Blue Cross committed a breach-of-contract for not paying about $205,000 of medical costs related to the out-of-state liver transplant he undergone.

However, Blue Cross denied any wrongdoing since the operation was done outside the coverage territory of the company.

The real battleground lies in proving whether Nehme would have died if he waited to have his surgery in UCLA.

Nehme claims that is the case while Blue Cross believes that there are not enough evidence to support that.

The trial is still ongoing and who knows how the jury will decide.

Many people, including me, would of course sympathize with Nehme.

Muni Involved in another Vehicle Accident

What is with the number of Muni vehicle accidents happening recently?
Just recently, an accident involving a Muni Railway trolley bus led to two men being struck by falling streetlights.

According to reports, the trolley pole of a 49 Van Ness-Mission bus got stuck in a support wire for the overhead Muni wires while on its way to Mission.

This caused the support wire to vibrate and dislodge two streetlights on either sides of the street.

The first streetlight struck an elderly man who was quickly brought to a hospital where he is expected to survive.

The second streetlight struck another man who refused medical treatment from paramedics.

The accident disrupted the Muni bus service in the excelsior for about 45 minutes.

We do not know what’s going on but something has to be done, in the last two weeks, we saw a collision between the J-Church and the –F-Market and a pedestrian accident involving another Muni bus.

Now we got streetlights falling on pedestrians.

As a common carrier, it is their duty to exercise the highest level of care when operating Muni vehicles.

Many are already thinking that these recent incidents may no longer be considered accidents but a product of negligence.

And I do not blame them.

City and Muni officials should start reviewing the operations of its vehicles to know which aspects should be improved upon to ensure the safety of their passengers and of pedestrians.

Authorities Investigate High-Speed Fatal Rio Linda Collision

Authorities are currently investigating a high-speed collision in Rio Linda that ended the life of one person and injured five others.

The woman who died in the accident was identified by the Sacramento County Coroner’s Office as Christine Anne Ingle, 45, from Rio Linda.

According to reports, authorities responded to a collision between a Ford Explorer and Mercedes that occurred along the intersection of C and 16th streets.

Police said the Mercedes driver was unable to stop at a stop sign prior to the collision.

A recent train accident could have resulted to at least three fatalities if only passersby did not stop to help a woman and her children trapped in their vehicle that was on the train tracks.

The unidentified woman was reportedly driving a northbound 2007 Honda Civic with her daughters, aged 7 and 10, when she fell asleep on Folsom Boulevard and drove onto a railroad track.

Witnesses and passersby were quick in getting the woman and her children out of the vehicle minutes before the passenger side of the Civic was totaled by a passing train. Neither one of the four passengers nor the train operator was hurt in the crash.

Though the train had damages, it was able to run after the debris of the crash was removed.

Train accidents often result to massive property damages or death. Luckily, no one was even slightly injured in this accident as the driver who fell asleep will be liable for her actions.

I hope next time she doesn’t put her children at risk by driving negligently. Fatigue should never be underestimated and drivers should get enough rest before they drive out the road.

Underage Driver Not at Fault in Fatal Crash

A 14-year-old Sanger boy who was heading east in a Toyota pick-up with an 18-year-old passenger got involved in a fatal vehicle accident after a westbound SUV crossed the double lanes and hit the approaching pick-up.

The SUV veered off the road and flipped over. The 35-year-old front seat passenger died at the scene while the driver, 30-year-old Similiano Carillo sustained moderate injuries. Carillo’s other 40-year old passenger sustained serious injuries. The teens in the pick-up were treated for minor injuries.

Clearly, Carillo is at fault in this accident. However, the 14-year-old driver shouldn’t be unpunished as what he did was negligent and dangerous. He was certainly driving without permit that time because he is not yet legally allowed to drive a vehicle.

I hope parents of teenagers who are learning to drive should restrict their children or allow them to practice with an experienced adult in areas where no one will be placed at risk.

Elderly Unsure of Hitting, Killing Teen

An elderly man called authorities after suspecting that he may have caused the death of a teen skateboarder in Vista recently.

The unidentified man, who is said to be around 90 years old, phoned authorities after he passed through a candlelight vigil for 15-year-old Lucas Giaconelli of Vista.

The man found out that the teen was skating with three of his friends in that area when he was hit at the back by a white Toyota Camry. The teen died at a hospital moments after the car accident.

Upon learning of the accident that killed Giaconelli the night before from the participants of the vigil, the man remembered hitting “something” in that area but never got out to check it. He suspects that he hit Giaconelli.

His suspicion is further backed by damages to his vehicle that authorities also discovered.

Elderly motorists should be more cautious when driving in poorly-lit or dark areas and always make it a point to check things out if they suspect that they hit something because their senses are not as sharp as they were before.

Hollywood Network Giants Settle Age Discriminations Suit Filed by Writers

In the largest settlement of its kind, two dozen entertainment companies have agreed to pay $70 million to settle an age discrimination suit that caps nearly a decade of legal battles.

The defendants in the case include network giants like NBC, ABC, FOX and CBS and several talent agencies.

According to the lawsuit, the defendants refused to hire or represent these writers because of their age and even if they are represented, the agents do not push them aggressively to studios for job openings.

According to the Age Discrimination in Employment Act or ADEA, employers are prohibited from discriminating against applicants and employees who are above the age of 40.

It is not clear yet how much each plaintiff is going to receive but a part of it is planned to be used as supplement to pension and to improve medical coverage.

Toyota to Recall 2.3 Million Vehicles with Gas Pedal Problems

Woman Killed in Colorado Snowboarding Accident

Both Cedars and Glendale use scanners from General Electric but the FDA has also received reports over problems with different brands of scanners, including models from Toshiba.

While brain scans were originally used to diagnose strokes, CT scans have become popular because they offer a cheap, quick and painless way for doctors to evaluate trauma, belly pain, seizures, chronic headaches and other ailments.

Massive Drop-Side Crib Recall Announced in US and Canada

The US Consumer Product Safety Commission and Health Canada issued the voluntary product recall of about 2 million drop-side cribs manufactured by Stork Craft.

The product recall covers about 1.2 million cribs in the US and about 968,000 cribs in Canada.

At least 147,000 of the cribs carried the brand Fisher-Price logo.

The product recall was prompted by reports of incidents where the drop-sides got detached.

All in all, there were 110 reported incidents received by the Consumer Product Safety Commission, health Canada and Stork Craft.

Police are yet to apprehend the driver in the fatal Prunedale hit-and-run accident which took the life of a 41-year-old man who was trying to cross the street.

Authorities speculate that the vehicle, which was either a red truck or an SUV, has damages on its front bumper after hitting Prunedale pedestrian Gregory Pryer.

Pedestrians should always be cautious when crossing the street and always use marked ways so that they can be seen by oncoming motorists.

The Google keyword war was taken to a whole new level when a Wisconsin law firm paid for the name of their competitor as their own keyword.

Now Canon & Dunphy law firm received a civil lawsuit from the owner of the name, the Habush Habush & Rottier Law Office.

What happened was that once you Google “Habush” or “Rottier”, a sponsored link of Canon would appear above the other results.

According to Habush, Canon and Dunphy has violated privacy laws by using the name of their competitor.

Habush claims that under Wisconsin right-to-privacy statute, a name of any living person cannot be used in advertising campaigns without consent.

Cannon acknowledged that they did pay for the keyword but claimed that it was a legal business strategy.

Most would disagree with Cannon though.

A lot of people would side with Habush that the move was very deceptive and misleading.

Besides, that is why businesses register their names to the Secretary of State, so that it will not be used by other entities, especially by competitors.

A business name is also their trademark and is protected by Intellectual property rights law.

The move undermines existing laws that protect the credibility built by the companies for themselves.

And even if it is legal, sometimes there are just lines that you do not cross.

The move was very underhanded and quite frankly, dishonest.

Suspected DUI Driver Detained by Authorities

Drunk driving is considered a serious offense because doing this act momentarily impairs drivers from driving responsibly. However, many drivers do not realize its effects until an accident happens.

A man was recently placed under custody on the suspicion of DUI in connection with a single-vehicle accident in Montebello that left three people injured.

According to authorities, one passenger sustained critical injuries while a second passenger and the driver sustained minor injuries after they were all ejected from the vehicle.

The driver who was identified as Lester Enrique Chupina, 33, from Whittier, was booked on the suspicion of drunk driving in relation with the crash that happened at the intersection of Garfield and Whittier.

Preliminary investigation revealed that the car was moving at an excessive speed when the driver crashed after losing control of the vehicle, police said.

Reports also stated that the car smashed into buildings and took out numerous palm trees.

The sheriff’s department said Chupina is being held on a $100,000 bail and may be arraigned in East Los Angeles.

The state should implement graver punishments to anyone who is found guilty of DUI so that the number of accidents caused by it will be lessened. In addition, the selling of alcohol should be closely monitored to prevent people from drinking too much before operating a vehicle.
